These terms of service ("Terms") apply to your access and use of Cipher (the "Service"). Please read them carefully.

2. Changes to Terms

We reserve the right to modify these Terms at any time. For instance, we may need to change these Terms if we come out with a new feature or for some other reason.

Whenever we make changes to these Terms, the changes are effective immediately after we post such revised Terms (indicated by revising the date at the top of these Terms) or upon your acceptance if we provide a mechanism for your immediate acceptance of the revised Terms. It is your responsibility to check Cipher for changes to these Terms.

3. Service Description

Cipher is a personal knowledge management platform that provides journaling capabilities enhanced by artificial intelligence. The Service includes:

  • Personal journal entry creation and storage
  • Automated contextual metadata capture (mood, weather, location, device information)
  • AI-powered analysis of journal entries using multiple frontier AI models
  • Pattern recognition and insight generation
  • Goal tracking and refinement

Our Service utilizes a sophisticated AI infrastructure that includes:

  • Self-hosted PostgreSQL and Qdrant databases for secure data storage and vector search capabilities
  • Integration with frontier AI models from OpenAI, Anthropic, and Google for comprehensive analysis
  • A proprietary Model of Experts (MoE) system that synthesizes insights from multiple AI models to provide optimal results
  • Advanced embedding technologies for semantic understanding and pattern recognition

4. User Rights and Responsibilities

You agree to:

  • Provide accurate and complete information when using the Service
  • Maintain the security of your account credentials
  • Use the Service only for personal, non-commercial purposes
  • Not attempt to circumvent any limitations or security measures
  • Not use the Service for any illegal or unauthorized purpose
  • Not create an account or post any content if you are not over 13 years of age

5. Data Privacy and Security

We take your privacy and data security seriously. By using the Service, you acknowledge and agree that:

  • Your journal entries and personal data are processed and stored securely in our self-hosted infrastructure
  • Your content is encrypted in transit using TLS 1.3 and at rest using industry-standard AES-256 encryption
  • Your content may be processed by various AI models to generate insights and patterns
  • Automated metadata collection is used to enhance your experience
  • You retain ownership of all content you create
  • We will not share your personal data with third parties without your consent

6. Subscription and Payment Terms

While the Service is currently in beta and free to access, it will transition to a paid subscription model. When launched:

  • The Service will be available on a subscription basis with recurring monthly payments
  • Payments will be processed securely through Stripe
  • Subscriptions will automatically renew unless cancelled
  • Beta users may receive special benefits upon commercial launch
  • Subscription fees may be modified with 30 days notice

7. Beta Program Terms

For users participating in our beta program:

  • Beta access is provided for a 14-day period
  • The Service may contain bugs or errors during the beta period
  • Features may be modified or removed without notice
  • Beta users may receive special benefits upon commercial launch
  • Feedback provided during the beta period may be used to improve the Service

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by us and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. This includes our proprietary AI infrastructure, MoE system, and any derivative insights generated by our AI models.

9. Limitation of Liability

THE SERVICE AND ANY OTHER SERVICE AND CONTENT INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE ARE PROVIDED TO YOU ON AN AS IS OR AS AVAILABLE BASIS WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND. WE DISCLAIM ANY AND ALL WARRANTIES AND REPRESENTATIONS (EXPRESS OR IMPLIED, ORAL OR WRITTEN) WITH RESPECT TO THE SERVICE AND CONTENT INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE.

IN NO EVENT WILL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

10. Governing Law

These Terms are governed by the laws of Australia. You and Cipher agree to submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia. Nothing in these Terms limits your rights under the Australian Consumer Law or other applicable Australian consumer protection laws.

If you are accessing the Service from outside Australia, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. The Service is controlled and operated from Australia, and we make no representations that it is appropriate or available for use in other locations.
